Calculating the value of economic disparity claims

If the income and living standards of your ex-partner are now significantly higher than yours because of financial sacrifices you made during the relationship, the Court can award a lump sum to compensate.

Such financial sacrifices occur upon the division of functions within the relationship; usually upon the arrival of children, and one parent puts their career on hold.

There is case law to consider; and there is an economic disparity model used in the Courts that can be the basis of the calculation.

Sutherland Forensic applies that model; to calculate the value of economic disparity claims for our clients; based upon their relationship property facts.

There are a range of factors to consider, such as: ages, years to retirement, salaries, NPV percentages, contingency percentages, employment histories, financial values, and enhancement of the working partner's career.

The disparity claim relates to section 15 of the Property (Relationship) Act 1976.
